Terms of Service

1. Agreement to Terms
By accessing or using TattleHash ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
TattleHash is operated from British Columbia, Canada. These Terms are governed by the laws of British Columbia and Canada.
2. Eligibility
You must be at least 18 years of age to use TattleHash. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
3. Description of Service
TattleHash is a cryptographic attestation service that creates blockchain-anchored proof of peer-to-peer transactions and agreements.
What TattleHash IS:
- An attestation and evidence-creation service
- A platform for recording timestamped, immutable proof of what was attested
- A tool that creates records designed to be admissible and persuasive in legal proceedings
What TattleHash IS NOT:
- NOT an escrow service - We do not hold, transfer, or guarantee funds
- NOT legal advice - We are not lawyers; consult a legal professional for legal matters
- NOT financial advice - We are not financial advisors; consult a professional for financial matters
- NOT a guarantee of legal outcome - Admissibility of evidence varies by jurisdiction
4. Service Tiers
TattleHash offers four attestation tiers:

| Fire | Proof with counterparty notification and PDF dossier |
| Gatekeeper | Mutual co-signing between two parties |
| Enforced | Mutual co-signing with fund availability verification |
Enforced Tier Disclaimer
The Enforced tier verifies fund availability only. Specifically:
- We verify that funds are available up to the requested transaction amount
- We do NOT expose, reveal, or record actual account balances
- The verification is a simple pass/fail: "sufficient funds available" or "insufficient funds"
- No balance information is stored, transmitted, or visible to any party
TattleHash does NOT:
- Hold funds in escrow
- Transfer funds between parties
- Guarantee fund availability at future dates
- Act as a payment processor or money transmitter
- Access, store, or share actual account balances
5. Attestation Permanence
Once an attestation is anchored to the blockchain:
- It cannot be edited by anyone
- It cannot be deleted by anyone - including TattleHash
- It cannot be reversed under any circumstances
- It will persist even if TattleHash ceases operations
By creating or co-signing an attestation, you acknowledge and accept that the record is permanent.
6. Account Responsibilities
Your Responsibilities:
- Maintain the security of your account credentials
- Protect access to your email address
- Secure any linked wallet addresses
- Review all attestation details before confirming
- Ensure accuracy of information you attest to
You Agree NOT to:
- Create false, fraudulent, or misleading attestations
- Impersonate another person or entity
- Use the Service for illegal purposes
- Attempt to manipulate or exploit the Service
- Share account access with unauthorized parties
- Circumvent security measures or rate limits
TattleHash is not responsible for unauthorized access resulting from your failure to secure your account.
7. Credits and Payment
Credit Purchases:
- Credits are the unit of account for TattleHash services
- 1 Credit = $4.99 USD (base rate)
- Volume discounts available for credit packs
Credit Policy:
- Credits are non-refundable once purchased
- Credits are non-transferable between accounts
- Credits do not expire under normal use
- Credit balances under 5 credits with no account activity for 36 consecutive months may be subject to a maintenance fee of 1 credit per year
Beta Period:
During the beta testing period, attestation fees may be waived or reduced. This does not constitute a permanent pricing commitment.
8. Beta Service Disclaimer
During beta:
- Features may change without notice
- Service may experience interruptions
- Transaction limits may apply
- Features may be added or removed
- Pricing is subject to change
THE SERVICE IS PROVIDED "AS IS" DURING BETA WITHOUT WARRANTY OF ANY KIND.
9. Beta Limits
During the beta period, the following limits apply:

| Maximum credit purchase per transaction | 25 credits |
| Maximum attestations per day per user | 10 |
These limits may be adjusted or removed at TattleHash's discretion.
10. Gamified Fee Splitting
Gatekeeper and Enforced attestations may include optional gamified fee determination (Coin Toss).
- Results are determined using provably fair blockchain randomness
- Neither party can influence the outcome
- The "sponsor" (party determined by the game) pays the full fee
- The "sponsored" party pays nothing
- Results are recorded in the attestation metadata and verifiable on-chain
There are no "winners" or "losers" - one party sponsors the attestation.
11. Downgrade Policy
If a Gatekeeper or Enforced attestation is initiated and the counterparty does not respond within 72 hours:
- The attestation automatically downgrades to Fire
- The initiating user receives a credit refund for the difference:
- Gatekeeper to Fire: 3 credits refunded
- Enforced to Fire: 9 credits refunded
- The user retains Fire-level proof (notification sent, PDF generated)
12. Intellectual Property
TattleHash Property:
- The Service, software, design, and branding are owned by TattleHash
- You may not copy, modify, or reverse engineer the Service
Patents Pending
TattleHash's cryptographic attestation system, including but not limited to:
- The provably fair blockchain-derived randomness mechanism (Coin Toss)
- The multi-party attestation and co-signing workflow
- The fund availability verification without balance disclosure method
- The automatic downgrade and credit refund system
- The blockchain anchoring and verification architecture
are the subject of pending patent applications. Unauthorized use, reproduction, or implementation of these methods, systems, or processes may constitute patent infringement and will be prosecuted to the fullest extent of the law.
Your Content:
- You retain ownership of content you submit for attestation
- You grant TattleHash a license to process and store your content as necessary to provide the Service
- Attestation metadata (hashes, timestamps, transaction IDs) become part of the permanent blockchain record
13. Privacy
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information.
By using TattleHash, you consent to the practices described in our Privacy Policy.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- TattleHash is not liable for any indirect, incidental, special, consequential, or punitive damages
- TattleHash is not liable for any loss arising from your use of attestations in legal proceedings
- TattleHash is not liable for unauthorized access to your account due to your failure to secure credentials
- TattleHash's total liability shall not exceed the amount you paid to TattleHash in the 12 months preceding the claim
TattleHash does not guarantee:
- Admissibility of attestations in any jurisdiction
- Any particular legal outcome
- Continuous, uninterrupted service
- That the Service will meet your specific requirements
15. Indemnification
You agree to indemnify and hold harmless TattleHash, its officers, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any attestation you create or co-sign
- Any dispute between you and a counterparty
16. Dispute Resolution
Between You and TattleHash:
Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in British Columbia, Canada, unless prohibited by applicable law.
Between You and Counterparties:
TattleHash is NOT a party to agreements between users. Disputes between you and your counterparties are your responsibility to resolve. TattleHash will not mediate, arbitrate, or adjudicate user disputes.
17. Termination
By You:
You may stop using the Service at any time. Remaining credit balances are non-refundable.
By TattleHash:
We may suspend or terminate your account if:
- You violate these Terms
- You use the Service for fraudulent or illegal purposes
- We are required to do so by law
- We discontinue the Service
Termination does not affect the permanence of attestations already created.
18. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via:
- Email to registered users
- Prominent notice on the Service
Continued use after changes constitutes acceptance of the modified Terms.
19. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
20. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and TattleHash regarding the Service.
